Commercial criminal law

The defence in white-collar criminal proceedings, the representation of companies and entrepreneurs in criminal law crises as well as advising companies on white-collar criminal law issues are not only our core competence, but our passion.

Entrepreneurial activity is risky work. Criminal law risks are omnipresent. Especially when economic risks materialise, criminal charges are quickly brought. Specialised public prosecutors subject entrepreneurial activities to a kind of criminal law performance review and use white-collar criminal law to bring about steering effects in their favour. It is no longer just the "classic" offences such as corruption, embezzlement or insolvency offences that are used. Formerly off-the-beaten-track special regulations such as criminal labour law, criminal capital market law and criminal customs and foreign trade law are also rapidly gaining in importance. The prosecuting authorities are arming themselves, no law is passed without the legislator qualifying any infringements as criminal offences or administrative offences, and the legal situation is becoming increasingly complex, not least due to the implications of European law.

In addition, white-collar criminal proceedings are increasingly "Gesamtkunstwerke", in which battles must be fought on several "fronts". If the defence lawyer ignores supposed "secondary battlegrounds", such as labour law, civil liability, insurance coverage, administrative reliability issues (e.g. in weapons law, hunting law, aviation law or foreign trade law), or even just overlooks the potentially existence-threatening effect of media coverage, even an acquittal can quickly become a "Pyrrhic victory".

In this complex web of interests and risks, we support you with our many years of experience and extensive expertise, not least from major proceedings, for example in the areas of "financial market", "Dieselgate" or "Cum/Ex".

With a clear strategy, we will help you to achieve the best possible result, whether you are the accused, an affected company, a witness, an injured party or in criminal law preventive advice and internal investigations.
