In order to better assess and ideally avoid criminal liability risks, decision-makers in the company are required to first obtain a well-founded legal assessment in the event of risk-related decisions. Those responsible in the company are - particularly in view of the so-called "business judgement rule" and the resulting duty to make enquiries - even obliged under certain circumstances to first obtain a legal opinion from a competent and expert advisor in such cases. This also applies in the case of the intended filing of criminal charges, which does not always prove to be a suitable measure and whose opportunities and risks must therefore be weighed up in each individual case.
