Company representation

One focus of our work is advising and representing companies in a criminal "crisis", i.e. in the context of criminal investigations against those responsible for the company or the company itself.

More and more often, companies are confronted with criminal proceedings that are not only directed against employees and those responsible, but increasingly also against the company itself. Although "corporate criminal law" as such does not (yet) exist in Germany, the possibility of the imposition of a so-called corporate fine and the confiscation of profits - in addition to the reputational risk associated with such proceedings - sometimes represents an economic risk for the company that could jeopardise its existence.

Our work includes providing strategic advice to the company in positioning itself vis-à-vis the investigating authorities and the public as well as managing and coordinating the overall proceedings with the individual defence lawyers of the accused employees and responsible persons (so-called socket defence).

In addition, we advise the company on coercive measures in criminal proceedings (e.g. searches or asset seizures) and support employees and managers as witness counsel during hearings. We also coordinate dealings with other third parties, such as supervisory authorities, insolvency administrators or D&O and legal expenses insurers.

Due to our many years of experience in numerous, sometimes highly complex large-scale proceedings, we not only have the necessary experience and expertise, but also a nationwide, top-class network of just as experienced experts who can be recommended and called in at short notice if required.
